Deputy Clerk J. Watts called the meeting to order at 6:30 p.m. Drainage Board members Deputy Mayor O'Reilly, Councillors Ashmore and Veale, and members C. Clarke, J. Oriotis, M. Verbik, and T. Willcox were in attendance.

Director of Engineering and Corporate Assets J. Rojas, Manager of Technical Services M. Farquhar and Senior Engineering Technician R. Monaghan were also in attendance.

Deputy Clerk Watts welcomed the new members of the Board, and explained the roles of Chair and Vice-Chair, and the nomination process.

Deputy Clerk Watts called for the nominations for the position of Chair.

Councillor Veale was nominated. Deputy Clerk Watts asked Councillor Veale if he wished to let his name stand for Chair of the Drainage Board. He consented to the nomination.

Deputy Clerk Watts called a second time for nominations for the position of Chair.

Deputy Clerk Watts called for a third and final time for nominations for the position of Chair.

Deputy Clerk Watts declared nominations for the position of Chair for the Drainage Board closed.

Deputy Clerk Watts declared Councillor Veale as Chairperson of the Drainage Board. 

Councillor Veale assumed his position as Chairperson of the Drainage Board.

Chair Veale called for the nominations for the position of Vice-Chair

Councillor Ashmore was nominated. Chair Veale asked Councillor Ashmore if they wished to let their name stand for Vice-Chair of the Board. He consented to the nomination.

Chair Veale called a second time for nominations for the position of Vice-Chair.

Chair Veale called for a third and final time for nominations for the position of Vice-Chair.

Chair Veale declared nominations for the position of Vice-Chair for the Drainage Board closed.

Chair Veale declared Councillor Ashmore as Vice-Chair of the Drainage Board.

The Chair thanked the members of the committee for the appointment as Chairperson of the Drainage Board.

Memorandum
Michael Farquhar Manager of Technical Services  – Engineering & Corporate Assets

Manager of Technical Services M. Farquhar presented an overview of the existing drainage in the area, and noted the areas of jurisdiction of Kawartha Conservation. He stated that attempts were made by the property owner for a mutual drain agreement, however after no success, a Petition for Drainage Works by Owners was filed and formally received by the Clerk's Office on December 2, 2021. He noted that the petitioners have until the meeting to consider, to remove their names from the petition. He responded to questions from the members of the Board.

    That the Memorandum from M. Farquhar, Manager of Technical Services - Engineering and Corporate Assets, December 9, 2021, regarding the Petition for Drainage Works by Owners of Concession 3, Part Lot 8, Geographic Township of Fenelon (being Michael Curtin) be received;

    That Council proceed with the petition submitted by Michael Curtin for drainage works for Concession 3, Part Lot 8 Geographic Township of Fenelon to be known as the Curtin Municipal Drain and instruct the City Clerk to proceed with the notices required under Section 5 of the Drainage Act;

    That Staff concurrently continue to pursue with the petitioners options for a mutual drain agreement as per the City Policy; and

    That pursuant to Section 8(1) of the Drainage Act, R.S.O. 1990, Chapter D. 17, staff recommend to Council a Drainage Engineer for the examination of the area requiring drainage and proceed with the requirements of the proposed Curtin Municipal Drain.

Michael Gerrits, P. Eng.
M. Gerrits Consulting Inc.

The Chair asked Drainage Engineer, Michael Gerrits, to present his engineering report on the Ops 4 Municipal Drain - Section 78 Improvement.

Mr. Gerrits provided a brief summary of his report prepared pursuant to Section 78 of the Drainage Act, RSO 1990. He identified the needs for the improvement to the Drain with special emphasis on the three deteriorating existing culverts underneath the Victoria Rail Trail near Lot 10, Concession 8, Ops. He noted that the estimated costs for the improvement work and replacement culverts is $96,470.00. The amount will be all assessed to the City of Kawartha Lakes and no other owners as per the Act.

Mr. Gerrits responded to questions from the members of the Board.

    That the City of Kawartha Lakes Drainage Board recommend that Council adopt the Ops 4 Municipal Drain Section 78 Report as prepared by M. Gerrits P. Eng, and instruct the Clerk to prepare the necessary by-law(s);

    That as the City of Kawartha Lakes is the sole assessed property for the Section 78 improvement of the Ops 4 Municipal Drain, Council deems no further Court of Revision proceedings are required; and

    That Council proceeds with the first second and third reading of a by-law to adopt the report.

Acting Drainage Superintendent and Senior Engineering Technician R. Monaghan provided a brief update of the work done on the following municipal drains:

  • Ops 1 Municipal Drain - clean out
  • Webster Municipal Drain - erosion repair
  • Miller Municipal Drain - clean out and catch basin repair
  • Ops 4 Municipal Drain - removal of beaver dam and widening of a ford crossing
  • Hancock (East) Municipal Drain - removal of beaver dam
  • Rogers Hancock Drain - outlet repairs due to erosion

R. Monaghan noted that a clean out was requested for the Kime Municipal Drain near White Rock Road and Salem Road. They are currently awaiting a permit from Kawartha Conservation to do the work which might begin in the summer. He responded to questions from the members of the Board.

Mr. Farquhar invited Michael Gerrits to comment on the Petition Drains he's working on.

Regarding the Desroches Municipal Drain, Mr. Gerrits stated that he is close to completing the report within the next couple of weeks. Regarding the Hugh Davidson Municipal Drain, he stated that the report was mostly complete, and that he was in communication with the petitioner to confirm final details. Regarding the Martin Municipal Drain, he stated that he had just received comments from Kawartha Conservation, and was still awaiting some comments from downstream owners, however anticipated the report to be completed soon. Mr. Gerrits responded to questions from the members of the Board.

Mr. Farquhar completed the update stating that the MacEachern Brown Municipal Drain Report was complete and plans are underway to bring it to a meeting of consideration in the new year. Regarding the Waite Municipal Drain, he stated that final approval of designs from Burnside Engineering were being reviewed by the Ministry of Transportation for the Highway 35 crossing, and he anticipated a final report complete in Q2 or Q3 of 2022
